A motor vehicle accident claim is a compensation claim made after you've been injured in a road incident — as a driver, passenger, motorcyclist, cyclist or pedestrian. In Australia, claims are made through your state's Compulsory Third Party (CTP) insurance scheme and, where eligible, through common-law damages.
Am I eligible to make a claim?
Eligibility depends on your state and the circumstances of the accident. Generally, you can claim if you were injured in an Australian road accident involving a motor vehicle, the accident wasn't entirely your own fault (rules vary by state), you've received medical attention, and you're within the notification time limits. Even if you were partly at fault, you may still have a claim.
What evidence do I need to support my claim?
You'll typically need: a police report or accident reference number, medical records and reports from your treating doctors, evidence of treatment costs and receipts, payslips or income evidence if claiming lost wages, photographs of vehicle damage and injuries where available, and witness contact details if any.
How long do I have to make a claim?
Time limits vary by state. In most states, you must notify the relevant insurer within months of the accident, with a longer period to formally lodge. Common-law claims have separate limitation periods, usually three years from the date of injury. Don't delay — missing a deadline can permanently extinguish your right to compensation.
How long does an MVA claim take?
